In New York many companies encouraging employees to cycle to work in an initiative to reduce the amount of cars on the roads. It is part of a pledge to make the city safer, improve quality of life, reduce traffic and reduce the amount of dangerous emissions.

Streets and sidewalks in New York make up 80% of the public space and they need to be suitable for everyone. It is important that all New Yorkers can use them safely, whether that’s for driving, riding a bike or just walking around.

Making the streets safer for bikes

Even though the main priority has previously been for cars whilst streets were being designed, these days other considerations are being made for pedestrians and in particular cyclists. Many more people are choosing to cycle these days so it is important to understand the ins and outs of bicycles in New York.

Cycling around New York is by no means a new fad and has always been an integral part of life. Over 200,000 people cycle around the city every day. Despite the large numbers of people already on their bikes, there is still a massive need for the streets to be safer as more and more people take to their bikes.

Over the past 4 years in part
icular, City leaders have begun to make a great impact on the streets of New York.

More than 250 miles of cycle lanes have been built over the past 4 years. As the streets improve for cyclists, in the form of cycle lanes and bicycle parking, more and more people are hoping on their bikes and enjoying them.

There are more cyclists on the road now than there ever has been. According to the Department of Health (DOH) there are now over 500,000 cyclists getting on their bike at least once a month.

The amount of daily commuters using their bikes to get to and from work rose by 13% over 2009 and 2010. In fact the Department of Transport states that the amount of regular cyclists on the streets has doubled in the past 4 years.

Despite the amount of cyclists on the streets growing by the year, the newly installed cycle lanes make the streets a lot safer. This goes for cyclists, pedestrians and vehicles. Streets with cycle lanes have around 40% less crashes ending in death or serious personal injury.

How cycle lanes make the streets safer:-

  • Many have refuge islands meaning a shorter distance for people on foot to cross the street
  • They normally have priority left turn lanes and signals, discouraging pedestrian violations and improving vehicle flow
  • Reducing cyclists using the sidewalk
  • Reducing vehicle speeding incidents

Cycling safely in numbers

Although there are more cyclists on the streets than ever before, it has never been safer to cycle in New York. The more cyclists that are on the street, the more drivers are aware of them.

Although bike lanes vastly improve safety for cyclists, now that drivers are used to seeing bikes on the streets they are more aware of them and look out for them.

Research has shown that when a city triples the amount of cyclists on the streets, accidents between drivers and cyclists is halved. The DOT has identified that this is happening in New York right now which is good news for everyone.23

Be a safe cyclist

In New York the same laws that apply to drivers also apply to cyclists. It’s important to be aware of these laws to avoid personal injury or becoming a hazard to pedestrians. Laws for cyclists vary slightly between states.

Tips for cycling safely in the streets of New York:-

  • Stay straight. Staying in a straight line as much as possible will mean drivers will find it easier to predict where you are going
  • Never assume you will be seen. Establish eye contact with drivers. Before turning look around you, signal and be sure a driver has seen you before manoeuvring
  • Leave 3ft between you and car. Both moving cars and stationary cars can open their doors without warning if they haven’t seen you
  • Be safe be seen. Always wear bright or fluorescent clothing. Ensure you have reflective areas on you and your bike as well as lights
  • Get a bell. A bell is required by law and it will notify people around you of your presence
  • Leave your headphones at home. Being able to hear traffic around you or warning signs is a must. The law states that cyclists are allowed one earphone in when on the roads but it is unadvisable
  • Helmets should be worn at all times. Although it’s not the law, helmets are proven to reduce personal injuries and save lives so really are a must

If you are unlucky enough to have an accident cycling around New York it is imperative that you know what to do afterwards. Contacting a New York bicycle accident lawyer should be your first port of call. They will assess the personal injury you have sustained and advise you on what to do next.

The hidden dangers of texting and driving

Posted by on 6:56 pm in Traffic accident | Comments Off on The hidden dangers of texting and driving

Using a phone is a part of most people’s lives. We are constantly looking at our phones throughout the day, and even during the night when we should be asleep. It’s a pretty unhealthy relationship. But nevertheless, it’s a part of our lives. The one place where it is never safe to glance at the phone or even use it is on the road behind the wheel of a vehicle. It is the most dangerous place where you can text or message friends and family. It can wait. Your life and the lives of those around you are more important than a message.

A cell phone can lead to a serious accident. Many drivers admit to texting at the wheel, and it is evident all around us. Just glance at other drivers while stopped at a red light and you will see that most of them are glancing at their phones, texting. Some don’t even see the light change because they are distracted. In the city of New York, texting while driving can lead to a personal injury for you or someone else. According to a Pew survey, forty percent of all American teenagers say they have been in a vehicle when the driver used a cell phones in a way that put them all in danger. Phones are distracting in every way. There is no other way to say it. Texting and messaging while in the car can wait. It’s not worth the accident, because it can happen to you.

Many times, distracted driving is caused by people looking at their phone and texting. It’s never safe to do so, even for a few seconds. That’s all it takes to cause an accident. This is most common in younger, less experienced drivers. Eleven percent of drivers ages 18 to 20 who were involved in a vehicle accident and survived admitted they were sending or receiving messages when they crashed. The evidence clearly shows how common distracted driving is, especially messaging on cell phones and driving. In New York, a personal injury can sometimes be caused by a distracted driver due to text messaging.

About two-thirds of drivers text while they are behind the wheel. Of those who post to Twitter, 30% say they do it while driving “all the time.”  Messaging, texting, updating social media and tweeting can lead to terrible and fatal accidents while behind the wheel of a vehicle. 46 states have banned text-messaging while driving. Cell phone use while driving is banned in 14, and the number will hopefully continue to grow among the states. Taking your eyes off the wheel isn’t worth the tragedy that may follow your selfish actions to glance at your phone.

31% of drivers in the United States between the ages of 18 and 64 reported that they have read or even sent a message in text or email form while driving at least once within the 30 days prior to being surveyed. That’s a huge majority of people freely admitting to something we know that we are all guilty of doing at one time or another. Many people will not admit to doing it, but we all know they have. In the city of New York, texting can lead to a personal injury when you least expect it.

Drivers need to always be prepared and aware while driving on the roadways. Put the phone away from view while driving to avoid being distracted. It’s not worth it. It’s always better to wait until you are parked in a safe location before texting. If you are ever involved in a crash due to distracted driving, always have a plan. You need an experienced lawyer when involved in an accident. Pulvers, Pulvers, Thompson and Friedman have the proven record to guarantee a successful result for you.121213

Taco Bell Employee Faces Criminal Charges After Assaulting Uber Driver

Posted by on 6:55 pm in Traffic accident | Comments Off on Taco Bell Employee Faces Criminal Charges After Assaulting Uber Driver

Taco Bell recently landed in the middle of a personal injury lawsuit involving an Uber driver. The driver’s evidence includes dashboard footage of him being severely beaten while at Taco Bell. Although Taco Bell isn’t directly involved in the case, one of their employees is.

The case cost Benjamin Allen Golden, a Taco Bell marketing executive, to be relieved of his position. Golden has a released a statement that his attorney, Courtney Pilchman, conveyed to the public. According to Ms. Pilchman, Golden has, “reached out to (victim Edward Caban’s attorney) to meet privately with his client so my client would have an opportunity to apologize in person. We’ll have to wait and see if he’s willing to accept that.”

Golden also reports that he is seeking counseling to help him manage his temper, though he doesn’t fully remember the events of the altercation. He does fully accept the blame for his actions.

The 23 year old Uber driver, Edward Caban, has been severely traumatized by the ordeal. According to his attorney, the young man has developed the habit of keeping a shotgun in close reach and has also struggled to sleep. His attorney reported, “This is basically a nightmare for him. He’s having a very, very tough time sleeping. As of yesterday I don’t think he’s slept at all. He’s still got fear. He’s fearful this guy will come after him. That may seem odd to you and I, but he’s never been in any sort of altercation of any kind.”

The interesting thing about the case was that Caban had the camera installed in his car after he’d been told about other customers having problems with orders and refunds. Many other Uber drivers have begun to do the same thing.

Golden does have a history of drinking problems, including a past arrest for drunk driving. Since than he reports he no longer drinks heavily, and that when he does drink, he makes an effort to be responsible, including finding someone else to drive him home.

Golden is now facing misdemeanor counts of assault, battery on a public transit employee resulting in injury, and assault on public transportation property. If the court finds him guilty, he could spend a year in jail and be responsible for a $10,0
00 fine.

In this case, the Uber driver handled the situation perfectly. He had his unit set up to gather evidence of crime and he also had the presence of mind when he was attacked to turn the camera so it recorded the assault. With this type of evidence, he should have no trouble mounting a personal injury case against Golden, a case that could result in a nice settlement.

Studies indicate that 31% of assaults that result in personal injury are triggered by alcohol. On college campuses this number is even higher, with alcohol playing a key role in 95% of violent crimes, most of which are violent assault or sexual assault.

If you are involved in a similar situation, it’s in your best interest to contact a New York personal injury lawyer and have them look over the details of your case. By retaining a New York person injury lawyer, you can insure that the assailant faces the stiffest penalty for their crimes. If your case is even half as strong as this poor Uber driver, there is every reason to believe that your New York personal injury lawyer will advise you to go forward with a lawsuit.

Nearly all of these children were severely disabled as a result of the medical mistake and the settlement had been awarded so that they would be able to receive future medical treatments long-term care. Winitch dealt with these settlements as guardian accounts.

Very strict guidelines had been attached to the guardian accounts, which included the type of investments that could be made with the money and the amount of fees the accounts would be charged. Winitch was supposed to hold onto STRIPS investments, United States bonds and treasury strips, until they matured. Instead he opted to take part in short-term trades, something he wasn’t legally permitted to do without first discussing it with the family connected to the account. As a result of the short-term trades, the accounts increased by $537,153, of which Winitch and his partner pocketed $196,431. When the NYSE learned about what Winitch had done, they deemed the action inappropriate given the nature of the guardian accounts.

Zeta Instrument Employee Killed In Bike Collision

Jeffery Donnelly, a Chief Operating Officer for Zeta Instruments, was tragically killed when a car collided with his bicycle in Palo Alto. Authorities reported that a teen was behind the wheel when the wreck occurred. The accident dealt a severe blow to both Donnelly’s friends and co-workers. Zeta Instrument’s CEO, Rusmin Kudinar, made a public statement addressing the accident. “He was a good man; a good friend. Everybody at work loved him. It was a shock to all of us. He was a very well-rounded, very bright person.” Donnelly had been an employee of Zeta Instruments since 2014. He is remembered by his wife and their three children.

32264591-morte-sur-le-passage-pour-pi-tons-horizontalAny good New York bicycle accident lawyer will tell you that not only are bicycle accidents tragic, they are also on the rise. The increased number of accidents like Donnelly’s that result from a car striking a cyclist have gone up as more people take to cycling in attempt to stay in shape and cut down on the cost of commuting. Some states have added bicycle lanes to major roads which has helped lower the number of bike vs. car accidents, but the new lanes haven’t eliminated the problem.

According to traffic experts, nearly one third of all bike accidents are caused by a car collision. These collisions are nearly always catastrophic with 75 percent resulting in traumatic brain injuries. It’s estimated that one cyclist dies in a fatal accident every six hours.

With these accidents on the rise, it’s important for all cyclists to be prepared and know how to respond in case a collision does happen on the road. If you or someone you love is injured in a bicycle crash, contact an attorney immediately. Even if you think you weren’t injured, you need to seek medical care since you could have injuries that won’t be noticed until later, something that’s not uncommon if you struck your head. Make sure you get all the insurance information from the driver. The most important thing to do when you’re in a car/bike collision is to make sure the police are called to the scene right away and that you get a copy of the report.

If you were injured in the accident, you are entitled to have your medical bills paid in full by the driver at fault. If the driver refuses to do so, you need to contact a New York bicycle accident lawyer who will prepare a case against them. During this process, you’ll learn that filing a lawsuit in a cycling accident is generally more complicated than if two cars collided, mostly due to the severe injuries sustained during the accident.

4
If someone you loved was killed as a result of a car collision with a bicycle, you should contact an attorney and determine whether or not you have grounds to file a wrongful death suit. The lawsuit won’t bring your loved one back, but it might prevent the same type of accident from happening to someone else in the future.
